GENERAL

Prices quoted are subject to change without notice.  The Owners reserve the right to amend or correct errors in advertised prices at any time. 

A charge for cleaning the villa before and after your stay is included, except for stays of less than 7 nights, when a £60 ($100 USD) cleaning fee is applicable.

A booking between the Owners and the person(s) making the booking (the Guest(s)) is valid only after the booking form has been completed and signed, the appropriate deposit paid to the Owners, and the booking confirmed in writing to the Guest(s) by the Owners.
The signing of the booking form confirms the acceptance of the terms and conditions set forth below and shall be binding on all persons named in said booking form.

RESERVATION DEPOSIT

A deposit of £150 ($250 USD) per week (or part thereof) is required to hold a reservation.  This is payable upon completion of the booking form, and is non-refundable in the event of a cancellation (see cancellation policy below).

RENTAL COST and PAYMENT

The rental cost is as specified on the booking form and is payable in full 8 weeks prior to commencement of the rental period.  Reservations for arrival within 8 weeks must be paid in full at time of reservation. 

Payment may be in the form of cheques or direct payment into the Owners’ bank account.  We also accept payment by major credit cards (this will incur a 5% surcharge).

RENTAL PERIOD and OCCUPANCY

The rental period runs from 4:00pm EST local time on day of arrival until 10:00am local time on date of departure (both dates to be taken from the booking form).  Unauthorized early arrivals or late departures will result in additional charges of £60 ($100 USD) per event.

The property may only be occupied by the persons named on the booking form.  In addition, only these named persons will be allowed to use the community facilities at Windsor Hills Resort (this is a requirement of Florida State Law).

Guests are advised that smoking is strictly prohibited, and pets are not permitted in the villa at any time.  Any violation of this rule will result in a 100% forfeit of the security deposit (see below).

SECURITY DEPOSIT

A security deposit of £350 ($500 USD) is required 8 weeks prior to commencement of the rental period.  The deposit will be refunded in full pending a satisfactory inspection report from the management company within 14 days of departure.

Guests will be held liable for the cost, without limit, of making good any and all damage or loss to the villa, furnishings or contents (including excessive use of utilities and/or additional cleaning) occurring during the rental period.

Should the security deposit be insufficient to cover the costs of repair, the guests will fully reimburse the owners of any outstanding amount within 14 days of departure.

CHANGES

The Owners reserve the right to charge £30 ($50 USD) per alteration to the booking form should any of the details sent require amendment.

Should you need to change the reservation dates, please be aware that rates are subject to change.  Dependant on availability, the Owners will try to accommodate the date changes.

CANCELLATION POLICY

All cancellations must be received in writing or email to the owners and confirmed.  The time of cancellation will be taken as the time the owners receive the written cancellation.

Should circumstance beyond the owners’ control require them to cancel a booking, you will receive a full refund of monies paid and no liability will be accepted.

More than 60 days prior to start of rental period: loss of full reservation deposit.
30 to 60 days prior to start of rental period: 50% of the full rental cost plus the deposit.
Less than 30days prior to start of the rental period: 100% of full rental cost.

LIABILITY LIMITATIONS

Neither the Owners nor the Owners’ Agent accept any responsibility or liability whatsoever for any of the following:

Loss, theft, damage or destruction of guests’ luggage or personal possessions at any time, through regular or improper use of villa utilities.
Any and all injuries to guests, or any other persons, occurring on or about the villa, however caused.
Any delay, disruption or changes to Guests’ vacation caused by FORCE MAJEUR events (e.g. strikes, riots, fire, flood, transport problems, inclement weather conditions) or any event beyond their control.
Failure of public supplies/ utilities (such as water, electricity, telephone, internet, cable TV), or for any actions taken in the vicinity of the property by any authority over which there is no control.

OTHER

The use of all accommodations and all amenities, including the swimming pool, spa and other facilities is entirely at the user’s own risk.
Care must be taken and children of all ages must be supervised at all times by a responsible adult either while in the pool or in the general pool area.
Please read and abide by the pool rules. Diving into the pool by anyone, of any age, is not permitted. Glass is not permitted within the pool area.
The villa is situated in a new development consisting of both residential and rental properties. Quiet time is from 10:00pm to 08:00am in the Windsor Hills Resort. There may be ongoing construction work. The Owners are not liable for any noise, nuisance or inconvenience suffered as a result of this.

WE STRONGLY RECOMMEND THAT ALL GUESTS ARRANGE PERSONAL TRAVEL INSURANCE BEFORE COMMENCING TRAVEL.

GOVERNING LAW

This agreement shall be governed by English Law in every particular including formation and interpretation and shall be deemed to have been made in England.  Any proceedings arising out of or in connection with this agreement may be brought in any Court of competent jurisdiction in England & Wales within one year of the rental period.  The submission by the parties to such jurisdiction shall not limit the right of the Owners to commence any proceedings arising out of this agreement in any other jurisdiction it may consider appropriate.

IMPORTANT ADDITIONAL INFORMATION

Pool Heating:  If you have selected pool heating, please remember that the owners and the owners’ agent cannot guarantee the actual temperature of the water in the pool.  The pool heater is set according to the manufacturers’ recommended settings so as to get the optimum benefit for our guests.  The actual water temperature is dependant on many factors including the ambient temperature, time of use and prevailing weather conditions.  If the air temperature drops below 50 degrees Fahrenheit, the heater, although functional, will be unable to transfer any heat to the pool water.

You must also be aware that, outdoor pool heating will at best, only take the chill off the water and heat it slightly.  It will not take the temperature to that of an indoor tub or spa. Please be advised that regrettably, under no circumstances will pool heat charges be refunded when the pool heater is functional.

The following are subject to charges:

Pool Safety Enclosure:  If this is taken down and not put back in position, a fee of £25 ($40 USD) is payable.

Toilet:  If the management company is called out to unblock a toilet, a fee of £75 ($120 USD) is payable.

Pool Screen Door:  If these are locked and the Management company is called out to unlock them, a fee of £25 ($40 USD) is payable.
